Terms and Conditions

These terms are the agreement between you and 97FX ("97FX", "we", "us"), of its registered office, for your use of 97fx.com, the 97FX mobile app and the services offered through them (together, "the service"). By creating an account you agree to them.

1. What 97FX is

97FX is a learning and education service about financial markets. It is not financial advice. The Educational Purpose Disclaimer is part of these terms; read it carefully.

2. Who can use the service

You must be at least 18 years old and able to enter into a contract. You must not use the service where doing so would break the law that applies to you.

3. Your account

• Give accurate information when you sign up, and keep your email address up to date.
• Keep your password and any two-factor codes secret. You are responsible for what happens under your account.
• One account is for one person. Team workspaces are for the people invited into them.
• Tell us straight away at Info@97FX.com if you think someone else has used your account.

4. Membership levels and payment

• The service has a free level and paid levels. What each level includes, and any monthly limits on how often a feature can be used, are shown in the service and may change.
• Paid levels are billed in advance on a recurring basis through our payment provider, Stripe, until you cancel.
• You can cancel at any time from the billing page. Your paid level continues to the end of the period you have paid for and then ends. If a payment fails, your account moves to the free level.
• Prices may change. We will tell you before a change applies to your next billing period.
• Refunds are given where the law requires them and otherwise at our discretion.
• If you are a consumer in the UK or EU you may have a right to cancel a new paid subscription within 14 days. By starting to use a paid level straight away you ask us to begin the service during that period, and you may be charged for the part you have used.

5. Acceptable use

You must not:

• copy, scrape, resell or redistribute data or content from the service, or use it to build a competing product;
• use automated tools to access the service, other than an API we give you access to;
• share your account or sign-in details;
• try to get around membership limits, security controls or access restrictions;
• interfere with the service, test it for vulnerabilities without our written permission, or introduce malicious code;
• use the service to break any law, including market-abuse and securities laws.

6. Data and third-party content

• Market data, news, filings and other third-party content belong to their owners and are provided to you for your own personal, non-commercial use within the service.
• News items link to the original publisher. We are not responsible for third-party websites.
• Data may be delayed, incomplete or wrong. See the disclaimer.

7. Connected brokerage accounts

If you connect a brokerage account, you authorise us to read account information from your broker on your behalf. We never receive or store your brokerage password. Your relationship with your broker is governed by your agreement with them. You can disconnect at any time.

8. Your content

Watchlists, portfolios, notes, picks, alerts and similar content you create remain yours. You give us permission to store and process them in order to provide the service to you, and to share them with your team where you choose to.

9. Our content

The service, its software, design and the 97FX name and logo belong to 97FX. We give you a personal, non-transferable, revocable right to use the service under these terms. Nothing else is licensed to you.

10. Availability and changes

We try to keep the service available but do not promise that it will be uninterrupted or error-free. We may change, add or remove features, including which features a membership level includes.

11. Suspension and closing your account

• You can stop using the service and ask us to close your account at any time by writing to Info@97FX.com.
• We may suspend or close an account that breaks these terms, puts the service or other members at risk, or is used unlawfully.

12. No warranties

The service is provided "as is" and "as available". To the fullest extent the law allows, we give no warranties about the accuracy, completeness or timeliness of any data or content, or about the service being fit for any particular purpose.

13. Limit of liability

To the fullest extent the law allows:

• we are not liable for trading or investment losses, lost profits, lost data, or indirect or consequential loss arising from your use of the service;
• our total liability to you in any 12-month period is limited to the amount you paid us for the service in that period.

Nothing in these terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, or for fraud. If you are a consumer, you keep the rights the law of your country gives you.

14. Privacy

The Privacy Policy explains how we handle your personal data, and the Cookie Policy explains the cookies we use.

15. Changes to these terms

If we change these terms we will publish the new version with its date and ask you to accept it when you next sign in. If you do not accept, you can close your account.

16. General

• If part of these terms cannot be enforced, the rest still applies.
• If we do not enforce a term straight away, we can still enforce it later.
• You may not transfer your rights under these terms to anyone else. We may transfer ours as part of a sale or reorganisation of the business.

17. Governing law

These terms are governed by the laws of the country where 97FX is established. Disputes will be heard by the courts of that country. If you are a consumer, you may also be able to bring a claim in the courts of the country where you live.
